{"id":800,"date":"2024-11-25T13:39:43","date_gmt":"2024-11-25T13:39:43","guid":{"rendered":"https:\/\/spkhmerlegal.com\/?p=800"},"modified":"2026-04-14T16:39:52","modified_gmt":"2026-04-14T09:39:52","slug":"curial-intervention","status":"publish","type":"post","link":"https:\/\/spkhmerlegal.com\/index.php\/2024\/11\/25\/curial-intervention\/","title":{"rendered":"Curial Intervention"},"content":{"rendered":"\n<p class=\"\">Generally, as a matter of law as well as principle of minimal curial intervention, the courts rarely interfere with the matters referred to the arbitration but until recent case law in Irish High Court.<\/p>\n\n\n\n<p id=\"block-646e52bc-b25a-45a9-9330-ae67ba0fe6a1\" class=\"\">Recently, the Irish High Court issued a decision up on a request made by a party to lift previous court order to stay of court proceedings to refer the matter to arbitration.<\/p>\n\n\n\n<p id=\"block-999f3264-2b4d-42a2-bf36-20340789910a\" class=\"\">The court originally granted a stay of court proceedings after parties agreed to refer the matter to arbitration on the condition that the claimant can request the court to lift the stay if the respondent did not engage with the arbitration in a timely and efficient manner.<\/p>\n\n\n\n<p id=\"block-aa40b881-abda-420d-9f31-148d2be6e929\" class=\"\">The Irish court had consistent rulings in the past that the matter was referred to the arbitration on the basis of the valid arbitration cannot return back to the court to litigate on the same matter. However, in this unusual case, it was the parties who made the agreement that one party can return back to court proceedings if the other party did not engage in the arbitration in a timely and efficient fashion. The court found that the respondent did not participate in the arbitration in the way the parties agreed before the court.
